STP is how employers report wages, PAYG withholding and superannuation to the ATO each time they run payroll. It’s mandatory for all employers regardless of size. Your payroll or accounting software handles the reporting automatically, but you need to make sure it’s set up correctly. A Lawpath accountant can help you get this right.
Single Touch Payroll Phase 2 became mandatory from 1 January 2022 — but a surprising number of small businesses are still on Phase 1 reporting or have errors that have stacked up unnoticed. Phase 2 expands the data the ATO collects each pay cycle, which means errors are more visible and more enforceable.
Super Guarantee must be paid to your clearing house by the 28th of October, January, April and July (quarterly). From 1 July 2026, the Government has legislated payday super — meaning super will need to be paid at the same time as wages.
Underpayment can trigger Fair Work Ombudsman action and back-pay orders. Since 1 January 2025, intentional underpayment of employees is a criminal offence in Australia, with significant penalties for both the business and individuals involved. The fastest fix is a payroll audit — we identify the gap, calculate back-pay correctly, and help you reach a voluntary disclosure agreement with Fair Work.
Yes. Lawpath’s accountants can advise on Modern Award rates, penalty rates, overtime and allowances across a range of industries. We also offer a free Pay Calculator tool that helps you determine the correct pay based on your employee’s award, role and employment type.
Lawpath’s accountants work with all major Australian payroll and accounting platforms including Xero, MYOB and QuickBooks. Whatever software you’re already using, our team can support you with setup, STP reporting and ongoing compliance.
Sometimes. Super applies to contractors paid mainly for their labour, even with an ABN. The ATO uses the “contract is wholly or principally for labour” test. Misclassifying employees as contractors triggers the Super Guarantee Charge plus penalties — a registered tax agent can review your contracts.
Most outsourced payroll services in Australia charge between $20 and $80 per employee per pay run. Lawpath’s payroll service is $50 per employee per pay run (minimum of 2 employees) — including STP lodgement, super calculation and dedicated payroll specialist.
